Terms of Service

Xsatori is operated by Xsatori Labs LLC, 4015 N 15th Ave, Phoenix, AZ 85015, United States (“Xsatori”, “we”, “us”). By creating an account, purchasing Xsatori Credits, or otherwise using Xsatori, you agree to these Terms of Service. If you do not agree, do not use Xsatori.

Xsatori is a play-money sports game. You use a virtual in-app currency called Xsatori Credits (“MC”) to buy, hold and sell virtual team positions called Minas. Mina prices move in response to buying and selling activity within the game and to the outcomes of real sporting events.

Xsatori is not a brokerage, exchange, sportsbook, betting service, money transmitter, or financial institution. We do not accept wagers and we do not pay out winnings. No activity on Xsatori involves real money changing hands other than your purchase of MC from us.

Nothing on Xsatori is financial, investment, tax or legal advice. Minas are not securities, commodities, derivatives, or investments of any kind, and confer no ownership interest in any team, league, or organization.

You must be at least 18 years old to use Xsatori. You may hold one account. You are responsible for keeping your login credentials secure and for all activity under your account.

You must provide accurate information when registering and keep it current. We may refuse, suspend, or close accounts at our discretion, including where we reasonably believe these Terms have been breached.

MC have no cash value. MC cannot be withdrawn, cashed out, redeemed for money, transferred to another person or account, sold, or exchanged for anything outside Xsatori.

MC are a limited, personal, non-transferable, revocable licence to use a feature of Xsatori. You do not own MC and MC are not your property. They are not a deposit, stored value, e-money, bank balance, security, or any form of legal tender.

MC do not expire while your account remains open and in good standing. We may change the price of MC packs, the amount of MC a pack contains, and the in-game cost of Minas at any time. Such changes are not retroactive to MC you already hold.

MC hold no value on termination. If your account is closed by you, or closed or suspended by us under these Terms, any MC balance and any Minas held are forfeited without compensation.

MC purchases are processed by Stripe. We do not receive or store your full card details. Prices are shown in US dollars and are exclusive of any applicable sales tax unless stated otherwise at checkout.

All MC purchases are final and non-refundable. MC are delivered to your account immediately on payment and are consumed within the game. We do not offer refunds, exchanges, or credit for MC, including for unused MC, for Minas that fall in value, for accounts closed at your request, or for accounts terminated for breach of these Terms.

This does not limit any rights you have that cannot be excluded under applicable consumer law. We may issue a refund at our discretion in cases of demonstrable technical error, duplicate charge, or unauthorized use of a payment method.

If a purchase is refunded or reversed for any reason, including a chargeback, the MC credited by that purchase are removed from your account. Where that MC has already been spent, your balance may be reduced to zero and we may suspend the account.

If you do not recognize a charge or believe a purchase was made in error, contact us first at info@xsatori.com. We will investigate and respond promptly. Charges from Xsatori may appear on your statement referencing XSATORI.COM.

Initiating a chargeback without contacting us first may result in immediate suspension of your account and forfeiture of any MC balance and Minas held.

Mina prices are determined by Xsatori’s own game mechanics. They are not market quotes, odds, or valuations of anything outside Xsatori. Prices can fall as well as rise, and a Mina can lose all of its in-game value.

Trading may lock before scheduled game start. Settlement occurs after we confirm a final result through our data providers. Where providers disagree, are delayed, or publish a correction, settlement may be delayed, adjusted, or reversed. We may correct in-game balances, holdings and prices to fix errors, and may void activity resulting from a bug, exploit, data error, or manipulation.

We may add, change, suspend or remove leagues, teams, Minas, game rules, and features at any time.

You may not: hold more than one account; use bots, scripts or automated means to interact with Xsatori; exploit bugs or pricing errors; manipulate prices in concert with others; buy, sell or transfer accounts or MC outside Xsatori; attempt unauthorized access; interfere with the platform or other users; upload malicious code; scrape abusively; or use Xsatori in violation of applicable law.

Where we reasonably believe you have breached this section, we may void affected activity, adjust balances, suspend or close the account, and forfeit MC and Minas without compensation.

Xsatori may be modified, suspended, limited, or discontinued at any time without notice. We do not guarantee uninterrupted access or error-free operation. We do not guarantee that any particular league, feature, or Mina will remain available.

All content, branding, design elements, text, graphics and other materials associated with Xsatori are owned by or licensed to Xsatori unless otherwise stated. Team names and marks referenced within Xsatori belong to their respective owners and are used for identification only. Xsatori is not affiliated with, endorsed by, or sponsored by any league, team, or athlete.

Xsatori is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant the accuracy, completeness or timeliness of any sports data, score, or result displayed.

To the fullest extent permitted by law, Xsatori and its affiliates, officers, employees and partners will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of Xsatori.

To the fullest extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to Xsatori will not exceed the total amount you paid us for MC in the twelve months before the event giving rise to the claim.

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of laws rules. You and Xsatori agree to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona.

We may update these Terms from time to time. We will update the “last updated” date above, and where changes are material we will take reasonable steps to notify you. Continued use after an update constitutes acceptance of the revised Terms.
